Client, a stained-glass conservation studio, sued a courier over a shattered panel. At the first meeting Client handed Attorney a signed note fixing the floor at the panel's insured value of $90,000 and directing that anything under it be turned down on the spot, because the studio's owner travels constantly and dislikes being interrupted for figures that go nowhere. Over eight months four offers arrived, the highest of them $61,000, and Attorney turned each one down the day it came. Attorney's monthly status letters described the state of the case, the discovery timetable and the trial window. The courier's insurer has since replaced the adjuster twice. Was it proper for Attorney to refuse the four offers?
