During the past year Attorney gave 40 unpaid hours to a state committee that drafts model jury instructions for the trial courts. The committee met nine times in a courthouse conference room, and Attorney wrote the instructions on comparative fault, circulating drafts to two trial judges and a law professor for comment. Every hour went into drafting and committee debate rather than into a client's file. The published set is now used in civil courtrooms across the state, and two law schools have reprinted the comparative-fault instructions in their trial practice manuals. Attorney's paying practice that year was commercial arbitration, and her firm booked the committee hours as a business development expense. Attorney is adding up the year's service. May Attorney count those 40 hours toward the yearly pro bono responsibility?
