Client, a family that runs a hot-air balloon operation, engaged Attorney to negotiate the sale of the business to a regional tour company. Attorney drafted the purchase agreement, ran the license transfer and had a signing set for the following month. Fourteen months into the engagement Client wrote: "We are moving the file to another firm. Your work has been fine, and this is simply what we have decided." Client repeated the instruction by telephone the same week. The engagement letter provided that a change of counsel before closing would add a tenth to accrued fees. Attorney replied that the discharge would take effect after the signing, kept the drafts, and spent the next two weeks revising the schedules and corresponding with the buyer's lawyer.
